Version dated 1 July 2020

This website is governed by Swiss privacy and data protection law, particularly the Federal Act on Data Protection (FADP) and any applicable foreign privacy and data protection legislation such as the General Data Protection Regulation (GDPR) enforced by the European Union (EU). The EU recognises that Swiss data protection law provides appropriate data protection.

We take the protection of your personal data very seriously. This Privacy Policy explains how, why and to what extent data is collected and used via our website. “Personal data” means any information by which you can be personally identified (including your name, email address and telephone number).

1. Privacy and data protection at a glance

The following information provides a straightforward overview of what happens with your personal data when you visit our website:

Who is responsible for collecting data on this website?
Data processing on this website is performed by its operator, w. wiedmer ag.

How do we collect your data?
One way in which we collect your data is by you providing us with it. For example, this could be details that you enter in a contact or enquiry form or send to us when you conclude a storage contract online. Other data is collected automatically by our IT systems as you visit the website. This will mainly be technical data (e.g. your web browser, the operating system, the date and time when you accessed the website). This data is collected automatically as soon as you visit our website.

What purposes do we use your data for?
We mainly use the personal data that we collect to conclude and process our contracts with our customers and business partners, i.e. in particular as part of providing removal and storage services to our customers. Some of the data is collected in order to ensure that the website is made available without any errors. Other data may be used to analyse your user behaviour.

What are your rights pertaining to your data?
You have the right at any time to obtain information free of charge regarding the origin, recipients and purpose of your personal data that we store. You also have the right to request rectification, blocking or erasure of this data.

Analytics tools and tools provided by third parties
Your surfing behaviour can be analysed statistically when you visit our website. This is mainly done using cookies and so-called analytics software. Your surfing behaviour will usually be analysed on an anonymous basis and cannot be traced back to you. You can object to this analysis or prevent it by opting not to use certain tools. Detailed information can be found in the Privacy Policy below.

2. Central storage

We store the provided data in a central electronic data processing system. The data pertaining to you is collected, linked and analysed systematically in order to process your moving and/or storage enquiry and to process the corresponding contractual services.

We base this processing on our legitimate interest within the meaning of Art. 6(1)f GDPR in managing customer data in an efficient and customer-friendly way. The processing of this data is also based on the performance of contracts within the meaning of Art. 6(1)b GDPR.

3. Data collection on our Webseite

3.1. Cookies
Cookies help to make many aspects of your visit to our website easier, more pleasant and more useful. Cookies are data files that your web browser stores automatically on your computer’s hard drive when you visit our website. Among other purposes, we use cookies to temporarily store the information that you enter when you fill in a form on the website, so that you do not have to input it again when you access a sub-page. Most Internet browsers accept cookies automatically. However, you can configure your browser in such a way that no cookies are stored on your computer or a message always appears when you receive a new cookie.

3.2. Server log files
The provider of the website automatically collects and stores information in so-called server log files, which your browser sends to us automatically. This information comprises:

  • Browser type and browser version
  • Operating system used
  • Referrer URL
  • Host name of the accessing computer
  • Date and time of server query
  • IP address

This data is not merged with any other data sources.

This data is collected and processed to enable our website to be used (establishing a connection), to keep the system permanently secure and stable, and to optimise our website, as well as for internal statistical purposes. This constitutes our legitimate interest in data processing within the meaning of Article 6 (1)(f) GDPR.

3.3. Integration of third-party services and content
Some third-party content, such as videos from YouTube, maps from Google Maps, RSS feeds, graphics from other websites, or downloads, may be integrated on our website. In each case, this requires the providers of this content (hereinafter referred to as “third-party providers”) to identify your IP address, because they will be unable to send the content to your browser without it. The IP address is thus required in order to display this content. We aim to only use content for which the providers use the IP address solely to deliver the content. However, we cannot prevent the third-party providers from storing your IP address for statistical purposes, for example.

4. Analytics tool and advertising

4.1. Google Analytics
We use Google Analytics, a web analytics service provided by Google LLC (“Google”). Google Analytics also uses cookies. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the US and stored there. Google is certified under the Privacy Shield agreement, which means it guarantees compliance with European privacy and data protection law: https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active

We only use Google Analytics with IP anonymisation activated. This means that your IP address will be truncated by Google in EU member states or in other signatory states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be sent to a Google server in the US and truncated there. Google will use this information on our behalf to analyse usage of the website, to compile reports on website activities and to provide us with other services related to website and Internet usage.

The IP addresses sent from your browser as part of Google Analytics will not be merged with any other data held by Google. You can also prevent Google from collecting and processing data generated by the cookie relating to your use of the website (including your IP address) by downloading and installing the appropriate browser plugin: https://tools.google.com/dlpage/gaoptout?hl=de You can find more information about how Google uses data, how to change your settings and how to object on Google’s websites. 4.2. Google Tag Manager
Google Tag Manager is a solution that enables us to manage so-called website tags via an interface and thus integrate e.g. Google Analytics and other Google marketing services into our website. The actual Tag Manager, which implements the tags, does not process any personal data of users. See the following information about Google services in respect of the processing of users’ personal data. Use policy: https://www.google.com/intl/de/tagmanager/use-policy.html

4.3. MailChimp (newsletter service)
Our newsletter is sent out using “MailChimp”, a newsletter mailing platform provided by the US-based Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, US. Besides your email address, all you need to provide to subscribe to our newsletter is your first name and surname. This information is used to personalise the newsletter and is stored on MailChimp’s servers in the US. MailChimp uses this information to send out and analyse newsletters on our behalf. Our newsletters contain a “web beacon”, a pixel-sized file that is retrieved from MailChimp’s server when the newsletter is opened. Technical information, e.g. about your browser, system and IP address, is collected in this process. This collection of data for statistical purposes also includes determining whether the newsletters are opened, when they are opened and which links are clicked on. Although it is technically possible to match this information up with individual newsletter recipients, neither we nor MailChimp have any intention of spying on individual users. The analyses are used to determine the reading habits of our users and adapt our content to them or to send different content in line with their interests. MailChimp is able to use the analyses to optimise its own services but will not use the details of our newsletter recipients to write to them itself or pass these details on to third parties. We will direct newsletter recipients to MailChimp’s website in some circumstances, e.g. to access a newsletter online or to correct email addresses that have previously been provided. Cookies are used on MailChimp’s website, meaning that MailChimp processes personal data. We have no influence over this gathering of data.

We trust MailChimp’s reliability and its IT and data security. MailChimp is certified under the US-EU Privacy Shield agreement and is thus committed to complying with EU privacy and data protection regulations: https://www.privacyshield.gov/participant?id=a2zt0000000TO6hAAG&status=Active

The processing of personal data for direct marketing purposes is to be regarded as processing serving a legitimate interest. Marketing emails are permitted if the marketing relates to similar offerings.

You can unsubscribe from our newsletter service at any time yourself by clicking on the link in one of the newsletters or by writing to us. If you have not subscribed to any newsletters or email services, no data of any kind will be transmitted.

4.4. SurveyMonkey (participation in surveys)
We use the service provided by SurveyMonkey Europe UC, 2 Shelbourne Buildings, Shelbourne Road, Dublin, Ireland to conduct surveys. If you volunteer to take part in such a survey, SurveyMonkey will collect information about the device and application that you are using to do so. This includes your IP address, the version of your operating system and your device type, as well as details of your system, its performance and your browser type. If you take part in a survey on a mobile device, SurveyMonkey will also log its UUID. In addition, SurveyMonkey uses so-called tracking services of third-party providers, who in turn use cookies and page tags (“web beacons”) to log usage data and user statistics.

We have no influence over the scope of the data collected by SurveyMonkey. More information about the cookies used by SurveyMonkey, about privacy and data protection, and about how long cookies are stored for can be found at: https://www.surveymonkey.de/mp/legal/privacy-policy/

We use SurveyMonkey to provide you with surveys. This purpose also comprises our legitimate interest in processing the abovementioned details, which is based on Art. 6(1)f GDPR.

SurveyMonkey Europe UC is a subsidiary of the US-based SurveyMonkey Inc. It cannot be ruled out that the data about you that SurveyMonkey collects will also be transmitted to the US. However, SurveyMonkey Inc. is certified under the US-EU Privacy Shield agreement. SurveyMonkey has thus committed to complying with the standards and provisions of European privacy and data protection law. You can find more information about the EU’s Privacy Shield and its validity at: https://www.privacyshield.gov/participant?id=a2zt0000000Gn7zAAC

5. General and mandatory information

5.1. How long personal data is stored for
We process and store your personal data for as long as it is required for the fulfilment of our contractual and legal obligations or for any other purposes served by its processing. In other words, this includes for the duration of the entire business relationship (from the initiation of a contract through to its performance and conclusion) and beyond in accordance with the statutory retention and documentation obligations. This means that personal data may be retained for the period of time during which claims can be asserted against our company and insofar as other legal obligations or legitimate business interests require us to do so (e.g. for evidence and documentation purposes). As soon as your personal data is no longer required for the abovementioned purposes, it will be erased, deactivated or anonymised as far as possible as a basic principle. Shorter retention periods of twelve months or less apply to operational data (e.g. system reports and logs) as a basic principle.

5.2. Data security
We take appropriate technical and organisational security precautions to protect your personal data from unauthorised access and misuse. These include putting in place policies, IT and network security solutions, access controls and access restrictions and the encryption of data carriers and transmitted data. Since data can be exposed to security vulnerabilities when it is transmitted via the Internet (e.g. when communicating by email), it cannot be protected completely against access by third parties.

5.3. Obligation to disclose personal data
You are required under our business relationship to provide the personal data needed to establish and implement a business relationship and fulfil the associated contractual obligations (you will generally not be obliged by law to furnish us with data). Without this data, we will not usually be able to conclude or perform a contract with you (or the entity or person you represent). Our website also cannot be used if certain information required to ensure data transmission (e.g. your IP address) is not disclosed.

5.4. Rights of the data subject

Within the scope of the privacy and data protection legislation applicable to you and to the extent provided for therein (e.g. in the case of the GDPR), you have the right to information, rectification and erasure and the right to restrict data processing and, in all other respects, to object to our data processing as well as to the release of certain personal data in order to transfer it to another entity (“data portability”).

Please note, however, that we reserve the right for our part to enforce the restrictions provided for by law, e.g. if we are required to retain or process certain data, have an overriding interest in doing so (insofar as we are entitled to assert this) or require it in order to assert claims.

Please also be aware that exercising these rights may conflict with contractual agreements and may have ramifications such as the early termination of your contract or cost implications. We will inform you in advance insofar as this is not already covered in your contract.

Exercising such rights usually requires you to provide clear evidence of your identity (e.g. via a copy of your passport or identity card insofar as your identity is not otherwise clear or cannot be verified). You can contact us at info@wiedmer.ch to exercise your rights.

All data subjects also have the right to enforce their claims in court or file a complaint with the competent data protection authority. The competent data protection authority in Switzerland is the Federal Data Protection and Information Commissioner (http://www.edoeb.admin.ch).

5.5. Amendments

We may amend this Privacy Policy at any time without prior notice. The latest version published on our website, as amended from time to time, shall always apply. Insofar as the Privacy Policy forms part of an agreement with you, we shall notify you of any amendments by email or in another appropriate way.
